THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.9545 OF 2022 O R D E R:
This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure (for short "Cr.P.C") seeking regular bail to the petitioners who are arrayed as Accused Nos.1 and 2 in Crime No.288 of 2022 pending on the file of Station House Officer, Narsampet Police Station, Warangal District registered for the offences punishable under Sections 306 and 290 read with Section 34 of Indian Penal Code (IPC).

Heard learned counsel for the petitioners/Accused Nos.1 and 2 and learned Additional Public Prosecutor for the respondent-State. Perused the record.

The case of the prosecution is that the de facto complainant who is the daughter of the deceased filed a written complaint stating that totally an amount of Rs.1,20,000/- was given by her mother to the 1st petitioner as debt. However, when her mother asked to return the said amount for paying college fees of the de facto complainant, the petitioners without giving the said amount, abused her in filthy language. For which reason, the
mother of the de facto complainant consumed poison and died after two days while undergoing treatment.

As seen from the complaint, it is a case where there are money transactions in between the petitioners and the deceased; and for the alleged reason of not returning the amounts which were given to the petitioners by the deceased, she committed suicide. 5.
In the said circumstances, since the petitioners are in jail from 28.09.2022 and the major part of the investigation is complete, the prayer for regular bail can be considered. 6.
Accordingly, the Criminal Petition is allowed and the petitioners/Accused Nos.1 and 2 are granted bail subject to the following conditions:
i) The petitioners/Accused Nos.1 and 2 are directed to be released on bail on their executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each with two sureties for a like sum each, to the satisfaction of Judicial First Class Magistrate at Narsampet.
ii) After release on bail, the petitioners/Accused Nos.1 and 2 shall appear before the concerned Station House Officer on every Monday between 10.30 AM and 01.00 PM for a period of eight (08) weeks and thereafter as and when required for the purpose of investigation.
iii) The petitioners/Accused Nos.1 and 2 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. Miscellaneous applications, pending if any, shall stand closed. _____________ K.SURENDER, J Date: 07.11.2022 ns
