THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.7346 OF 2017 ORDER:

This Writ Petition is filed, under Article 226 of the Constitution of India, for the following relief: "to issue an appropriate Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring action of the 2nd respondent in not deciding the statutory appeals filed by the petitioners against the orders of the 3rd respondent in rejecting the building permissions, as arbitrary, illegal, failure to exercise power, violative of the procedure contemplated under the provisions of the A.P.Panchayat Raj Act, 1994, violative of Fundamental Rights guaranteed under Articles 14 & 19 and the Constitutional Right guaranteed under Article 300-A of the Constitution of India and consequently direct the 2nd respondent to decide the appeals by granting building permissions."

Heard the learned counsel for the petitioners and Sri Ravi Cheemalapati, learned Standing Counsel for respondent Nos.2 and 3.

During the course of hearing, it is brought to the notice of this Court by the learned counsel for the petitioners that in identical set of circumstances, the adjacent land owners of the petitioners filed W.P.No.26356 of 2016 before this Court and this Court disposed of the said writ petition by way of an order, dated 05.08.2016 and a copy of the said order is also placed on record along with the writ petition.

Following the above said order and for the reasons recorded therein, this Writ Petition is also disposed of directing the 2nd

AVSS,J wp_7346_2017 respondent Gram Panchayat to dispose of the appeals, dated 31.12.2015, filed by the 1st petitioner, on 14.10.2015 filed by petitioners 2 to 4 and 8; on 18.11.2015 filed by petitioners 6 and 9; and on 18.11.2016 filed by petitioners 5 and 7, in accordance with law, as expeditiously as possible, preferably within a period of one month from the date of receipt of a copy of this order.
