HON'BLE SRI JUSTICE S.V. BHATT W.P. No.44965 OF 2016 ORDER:

Heard Mr.P.Srinivas Rao for petitioners, Mr.G.Narender Reddy for 3rd respondent and Mr.V.Srinivas for 4th respondent. The petitioners are aggrieved by the promotion given to 4th respondent as Superintendent, and according to petitioners, the 4th respondent is not entitled for consideration, for the 4th respondent was working as U.D. Steno. Admittedly, as on date on the objections raised by the petitioners, the promotion given to 4th respondent is, in fact, not implemented. According to the counter affidavit filed by 3rd respondent, the 3rd respondent has sought for clarification from 2nd respondent, and a suitable decision on the promotion to the post of Superintendent will be taken.

The learned counsel at the first instance submitted on merits of the respective claims, and after noticing the pendency of issue before the 2nd respondent, have consented to directing the 3rd respondent firstly, to receive remarks/ reply sought for from 2nd respondent and secondly, hear the petitioners as well the 4th respondent and take a decision on filling up of the post of Superintendent, within four weeks from the date of receipt of a copy of this order. The statement is placed on record and the writ petition is disposed of by this order:

The 3rd respondent is directed to dispose of the issue of filling up of vacancy of Superintendent, within four weeks from the date of receipt of a copy of this order. Both the parties are given liberty

to file additional representation, if any, in support of their respective assertions, within a period of two weeks from today. The 2nd and the 3rd respondents are directed to maintain status quo for a period of six weeks from today vis-à-vis the filling up of post of Superintendent. The 3rd respondent, if could dispose of the objections within six weeks, subject to such decision the post can be filled up.

No order as to costs.
