The petitioner is the accused No.3 among 8 accused of Crime No.190/2017 of II town Police Station of SPSR Nellore District registered on 20.09.2017, for the offences punishable under Sections 143, 147, 148 307 r/w 149 IPC. The petitioner is seeking anticipatory bail. 2.

Heard the counsel for the petitioner and learned Assistant Public Prosecutor in opposing the same and perused the FIR and the remand report of A1 and A6 dated 13.07.2018 and dismissal of the anticipatory bail application of the petitioner by the learned Sessions Judge in Crl.M.P. No. 1158 of 2018 dated 22.06.2018. Though it is the contention of the counsel for the petitioner of A5 that accused Nos. 1,2,4,6 to 8 were granted regular bail, no order copy filed and as per the instructions received by the learned Assistant Public Prosecutor, in writing, from the Police, as on 09.08.2018 none were granted any concession of bail. 3.

Having regard to the above and from the manner in which the crime committed, the petitioner is not entitled to the concession of the anticipatory bail. However, it will not prejudice any of his right to surrender and move for regular bail if others granted regular bail by approaching the Court of Session also by virtue of this order. 4.

In view of the above, the Criminal Petition is dismissed. Miscellaneous petitions pending, if any, shall stand closed. ____________________________ Dr. B. SIVA SANKARA RAO, J 21nd August, 2018.
