Learned counsel for the appellant, Sri G. Anandam, would submit that long back the appellant has taken away the file as well as 'No Objection' Vakalat, but, still his name is appearing. Therefore, he intends to send notice.
When 'No Objection' Vakalat was handed over, including the file, long back, it appears that the appellant is not inclined to prosecute the appeal.
Learned counsel for the respondent No.1 is present. In fact, there is no necessity to list the matter under the caption 'For Dismissal', when the appellant is not getting ready. Hence, the Appeal is dismissed for non-prosecution. As a sequel thereto, miscellaneous petitions, if any, pending in the Appeal shall stand closed.
