Heard the learned counsel for the petitioner and Sri N.Siva Reddy, learned Standing Counsel for respondents. 2.

Petitioner assailed in this Writ Petition provisional assessment notice dt.11-05-2018 determining that the petitioner is liable to pay a sum of Rs.1,93,682/- after an inspection was made on 09-05-2018 on the premises in his occupation where it is alleged that pilferage of energy was discovered. The impugned notice directs the petitioner to pay the entire amount for restoration of power supply. 3.

In similar circumstances, this Court has passed order directing restoration of power supply on payment of 50% of the provisional assessed amount by the consumer and directed the respondents to refer the matter to the Special Court under Section 154

(5) of the Electricity Act, 2003.

Therefore, this Writ Petition is also disposed of directing the respondents to restore power supply to the petitioner premises subject to the petitioner paying 50% of the provisional assessed amount within four weeks from today; on such payment by the petitioner, the power supply so restored shall not be disconnected; and the respondents shall refer the mater for determination of civil liability to the Special Court under Section 154 (5) of the Electricity Act, 2003. No costs.
