HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.31144 of 2017 ORDER:

This writ petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking to declare the action of the 2nd respondent/Project Director in terminating the petitioner from service vide proceedings Rc.No.A2/621/HR12015, dated -08-2017, without appreciating the report in proper manner and also ignoring the order of the Commissioner, Panchayath Raj and Rural Development, Andhra Pradesh, as illegal, arbitrary and unconstitutional and in violation of Article 300-A of the Constitution of India and consequently direct the respondents to restore the employment of the petitioner as field assistant.

Heard Sri M.P.V.N.V. Sastry, learned counsel for the petitioner, learned Government Pleader for Panchayat Raj for respondents 1 & 6, Sri M.S.R. Chandra Murthy, learned Standing Counsel for the 4th respondent and Sri Cheemalapati Ravi, learned Standing Counsel for the 5th respondent. Perused the material available on record.

When the matter is taken up for consideration, Sri M.S.R. Chandra Murthy, learned Standing Counsel for the 4th respondent submitted that against the impugned order, an appeal shall lie to the District Collector and the same is not disputed by the learned counsel for the petitioner.

In view of the same, the Writ Petition is dismissed by granting liberty to the petitioner to file an appeal before the District Collector within a period of two (2) weeks from the date of receipt of a
