THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.1632 OF 2016 ORDER:
This Criminal Revision Case is filed by the petitioners challenging the order dated 17.6.2016 passed in Crl.M.P.No.161 of 2016 in Crl.A.No.528 of 2016 by the III Additional Metropolitan Sessions Judge, Ranga Reddy District at L.B. Nagar. In C.C.No.171 of 2015 on the file of the IX Special Magistrate, Ranga Reddy District at Hasthinapuram, the petitioners were convicted for the offence under Section 138 of the Negotiable Instruments Act and sentenced for the said offence to undergo simple imprisonment for a period of one year each and to pay compensation of Rs.8,00,000/- each to the complainant, and the 2nd petitioner was also directed to pay additional compensation of Rs.9,00,000/-, in default to undergo simple imprisonment for a period of one month each. Aggrieved by the same, the petitioners-accused filed the above Criminal Appeal.
Along with the appeal, they filed the above Crl.M.P. seeking to suspend the execution of the judgment in the above C.C. While suspending the sentence, the learned III Additional Metropolitan Sessions Judge, Ranga Reddy District at L.B. Nagar, held that the petitioners are entitled for bail only on deposit of Rs.5,00,000/-each within three weeks from the date of the order. Aggrieved by the said condition, the petitioners filed this revision. Heard and perused the material available on record. Learned Additional Public Prosecutor opposed this petition.
"The condition imposed by the learned III Additional Metropolitan Sessions Judge, Ranga Reddy District at L.B. Nagar, in the order impugned, holding that the petitioners are entitled for bail only on deposit of Rs.5,00,000/- each, alone is set aside. Rest of the order impugned herein shall remain."
Accordingly, the Criminal Revision Case is disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed.
