THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.27457 OF 2016 O R D E R :

This petition is filed for a writ of Mandamus declaring the action of the 3rd respondent in trying to interfere and to dispossess the petitioner from the land to an extent of Ac.0.05 guntas in Survey No.255/AA, situated at Vengannapalem, Gundepudi, Julurpad Mandal, Khammam District in collusion with Respondent No.4, as illegal and arbitrary.

Learned Assistant Government Pleader for Revenue produced written instructions from the Tahasildar dated 22.08.2016 wherein it is stated that the subject land is a private patta land and that the 4th respondent filed civil suit in OS.No.263/2016 against the petitioner. It is also stated that the Mobile Court, Bhadrachalam has granted temporary injunction on 19.07.2016 in IA.No.297/2016 in the aforesaid suit. Further, the 3rd respondent against whom this writ petition is filed is not a party to the said suit and that the 3rd respondent never tried to dispossess the petitioner from the subject land.

In view of the above, I do not see any reason to entertain the writ petition.

Accordingly, the writ petition is dismissed. However, it is for the petitioner to workout his remedies in civil suit in OS.No.263/2016. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
