HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.34320 of 2016 ORDER:

This writ petition is filed seeking to issue a Writ of Mandamus directing the 1st respondent to consider the representation/application of the petitioner, dated 26.9.2016 for extension of parole period granted to him vide G.O.Rt.No.649, Home (Parole & HRC) Department, dated 3.9.2016.

It is stated in the affidavit that the petitioner is a convict and he has been undergoing the sentence imposed in Sessions Case No.78 of 2008 by the IV Additional Sessions Judge, Markapur, Prakasam District. He filed appeal in Crl.A.No.1381 of 2011 before this Court and the same is pending. While so, on his request, the Government granted parole vide G.O.Rt.No.649, dated 3.9.2016 directing him to surrender again on 14.10.2016 on expiry of parole, and then, he was released from jail on 13.9.2016. It is stated that the mother of the petitioner is bedridden and she has to undergo surgery on 20.10.2016 and therefore, he made an application to the 1st respondent to extend the period of parole. 3.

Heard and perused the material available on record. 4.

The learned Counsel for the petitioner submitted that the petitioner surrendered on 14th October, 2016 as per the G.O.Rt.No.649, dated 3.9.2016 and therefore, his request may be considered. 5.

Considering the circumstances of the case, this Court is inclined to pass the following order:

"The 1st respondent is directed to consider the representation/application of the petitioner dated 26.9.2016 sympathetically and pass appropriate orders." 6.

With the above direction, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
