THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.8341 of 2018 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C., seeking to quash the proceedings in Crime No.459 of 2018 of Jawaharnagar Police Station, Rachakonda District, registered for the offences punishable under Section 420, 464, 448, 468, 471 and 506 read with 120-B IPC, against the petitioners/A.1 to A.11. 2.

After arguing the matter for a while, learned counsel for the petitioners requested the Court to issue a direction to the Station House Officer, Jawaharnagar Police Station, Rachakonda District, to follow the procedure under Section 41-A Cr.P.C and the guidelines issued by the Apex Court in judgment reported in Arnesh Kumar v. State of Bihar and another1, while investigating the above crime. 3.

Acceding to the request of learned counsel for the petitioners, the Criminal Petition is disposed of directing the Station House Officer, Jawaharnagar Police Station, Rachakonda District, to follow the procedure under Section 41-A Cr.P.C and the guidelines issued by the Apex Court in the above referred Judgment, before taking any coercive steps against the petitioners.

Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
