JUSTI CE V.RAMASUBRAMANI AN And CI VI L REVI SI ON PETI TI ON No.1106 of 2009 ORDER: (Per VRS,J) The petitioner has come up with the above revision petition challenging an order of the Court below refusing to condone the delay in filing the petition under Section 34 of the Arbitration and Conciliation Act, 1996.

2. Heard learned counsel on both sides.

3. The Arbitration Award was dated 18.09.2005. The petition to set aside the same under Section 34 was filed on 03.04.2007. The petition under Section 34 is liable to be filed within a period of 30 days. Under sub-section (3) of Section 34 the Court is competent to condone the delay up to a period of 30 days. But unfortunately, the O.P. was filed beyond the condonable period. Therefore, the trial Court had no alternative, except to dismiss the condone delay petition. Hence we find no reason to interfere with the said order.

4. Therefore, the civil revision petition is dismissed. As a sequel, miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
