THE HON'BLE SRI JUSTICE C.V.BHASKAR REDDY Contempt Case No.1226 of 2015 ORDER:

This Contempt Case is filed alleging violation of orders dated 09.07.2014 passed by this Court in W.P.No.16420 of 2013. By the above said order this Court has directed that in case respondent No.3 fails to remove the illegal and unauthorized construction on his accord within one (1) month from the date of the order, respondent No.1/ GHMC shall take action within one month thereafter for removal of the deviations and extra floors. Today learned counsel appearing for respondent No.2 submits that in compliance of the directions of this Court, the illegal constructions are partly removed and the said construction is not put to use in any manner by respondent No.3.

This Contempt Case is pending from 2015 and so far this Court has not taken any cognizance under section 17 of the Contempt of Courts Act.

Recording the above submission, this Contempt Case is closed. However, the respondents are directed to see that respondent No.3 shall not proceed with any construction without obtaining any sanctioned plan from the Municipality. Liberty is also granted to the petitioner, if any cause survives, to file fresh application seeking revival of the contempt case in accordance with law.

Miscellaneous petitions, if any pending in this contempt case shall stand closed.
