HON'BLE SRI JUSTICE SURESH KUMAR KAIT A.S.M.P.No.649 of 2014 and A.S. No.147 of 2014 ORDER:

Appeared none on behalf of petitioners on 01-06-2016, however, in the interest of justice this Court deferred from passing adverse order against petitioners. Accordingly, the matter was posted on 07-06-2016 'for dismissal'. On 07-062016, at the request of learned counsel for petitioners, A.S.M.P. No.649 of 2014 was again adjourned and directed to be listed after four weeks. In the meanwhile, the petitioners were directed to take steps to serve personal notice on respondent No.5.

Today, when the matter is taken up, it is found that neither steps have been taken to serve personal notice on respondent No.5, or appeared none on behalf of petitioners. It seems the petitioners are no more interested to prosecute the Appeal Suit. The Appeal Suit is accordingly dismissed for default and non-prosecution as well.

Miscellaneous petitions, if any, pending in this Appeal Suit shall stand closed.
