THE HON'BLE SRI JUSTICE N.TUKARAMJI CRIMINAL PETITION NO. 10317 OF 2021 ORDER:

This petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail by the petitioner/A1 in COR.No.118 of 2021 on the file of Prohibition and Excise Station, Khammam II Town Police Station, registered for the offence punishable under Section 8(c) read with Section 20(b)(ii)(c) of Narcotic Drugs and Psychotropic Substances Act, 1985. 2.

The learned counsel for petitioner/A1 submits that the other Accused in the crime was enlarged on bail by this Court vide order dated 8.12.2021 in Criminal Petition No.8876 of 2021 and prayed for extending the same view as the case of the petitioner is also selfsame. 3.

The learned Additional Public Prosecutor opposed the petition, but did not raise any specific objection.

Having regard to the fact that the other Accused who is facing same acquisitions in the occurrence was enlarged on bail by this Court, the prayer of the petitioner/A1 for grant of bail found convincing.

The Criminal Petition is therefore, allowed. Petitioner/A1 shall be enlarged on bail in connection with Crime No.118 of 2021 on the file of Prohibition and Excise Station, Khammam II Town Police Station, Khammam district on his executing a personal bond for a sum of Rs.50,000/- (Rupees fifty thousand only) with two sureties for

a like sum each to the satisfaction of the Special Judicial Magistrate of First Class (Prohibition and Excise Cases) at Khammam. The Petitioner/A1 shall also appear before the Station House Officer on every Sunday between 10.00 a.m. and 1.00 p.m. till completion of trial and shall not leave the State till completion of trial. ___________________ N.TUKARAMJI, J Date :12.1.2022 DA
