THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 3857 of 2017 ORDER:
This writ petition was filed challenging the action of the respondents, particularly respondent No.5 in giving threatening calls to the petitioner, calling him to the Police Station and asking him to sit from morning to evening without any crime or complaint registered against him.
Learned Government Pleader for Home, on the basis of written instructions, submits that one Gude Venkatesh, Project Manager, BSNL Exchange, Kondapalli, Ibrahimpatnam lodged a complaint on 31.12.2016 before respondent No.5 stating that there was a theft of aluminium wires worth Rs.15,000/- by some unknown persons. Based on the same, Crime No.540 of 2016 was registered and the case was entrusted to CCS Vijayawada for further investigation. During the course of investigation, it came to know that the petitioner and three others have committed the offence and the same was recovered from Accused Nos.1 and 2. The petitionerAccused No.3 and Accused No.4 are absconding and Accused Nos.1 and 2 were arrested and sent to judicial custody. No coercive steps are taken except conducting investigation into the crime. In view of the aforestated statement, no further orders are necessary in the present writ petition, except directing the
respondents to follow due process of law during the course of investigation.
The writ petition is accordingly closed.
