HON'BLE SRI JUSTICE S.V. BHATT W.P.No.20694 OF 2015 ORDER:
The petitioners claim that respondent No.4 assigned house site pattas to them in Sy.No.2153 of Chanikyapuri, S.P.S.R Nellore District and are in possession and enjoyment of the assigned house plots. The 4th respondent during the currency of assignment is threatening to dispossess the petitioners or demolish the structures made by petitioners in the assigned land. The Assistant Government Pleader, on instructions, contends that the genuineness of pattas on which the petitioners are relying upon cannot and could not be examined by looking at the xerox copies on which reliance is made. The genuineness of assignment will be examined if the original pattas are produced before the 4th respondent by petitioners. The counsel for petitioners seeks time to make a request to 4th respondent and also produce the original assignments for inspection.
The request is accepted. The petitioners are given liberty to represent to 4th respondent for verification of original assignments in their favour and the 4th respondent, after verification of documents so produced by the petitioner, takes a decision in accordance with law. The writ petition is disposed of. There shall be no order as costs. Consequently, pending miscellaneous petitions, if any, stand closed.
