This Writ Petition is filed under Article 226 of the Constitution of India for the following relief : " For all the reasons stated above it is prayed that this Hon'ble Court may be pleased to issue a writ or order or direction more particularly one in the nature of Writ of Mandamus declaring that the action of the respondent No.2 in not promoting the petitioner as Supdt (Cash) from the post of Sr. Assistant (Cash)/Pay Clerk Grade-I is bad, arbitrary, illegal, unjust, unreasonable, discriminatory and violation of APSRTC Recruitment Regulations 2004 and consequently direct the respondents to effect promotion to the petitioner as Supdt.
(Cash) w.e.f.
6.1.2015 with all consequential service benefits and pass such other order or orders which this Court deems fit and proper."
Heard Sri P.Venkateswar Rao, learned counsel for the petitioner and Sri N. Vasudeva Reddy, learned Standing Counsel for the respondents.
During the course of hearing, it is submitted by the learned counsel for the petitioner that for redressal of his grievance, the petitioner submitted a representation dated 3.6.2015 to the 2nd respondent and that no orders have been passed on the said representation. Learned counsel for the petitioner requested that the said representation filed by the petitioner may be directed to be disposed of by
fixing time limit.
The said request has not been opposed by the learned Standing Counsel appearing for the respondents. Having regard to the above circumstances, without expressing any opinion on the merits of the case and also entitlement of the petitioner, the 2nd respondent is directed to pass appropriate orders on the representation dated 3.6.2015 said to have been submitted by the petitioner within a period of one month from the date of receipt of a copy of this order, as per law.
With the above direction, the writ petition is disposed of at the admission stage. Miscellaneous petitions pending, if any, shall stand closed. No costs. JUSTICE A.V.SESHA SAI Dt: 28.3.2016 KK
