THE HON'BLE SRI JUSTICE T. AMARNATH GOUD WRIT PETITION No.21004 of 2007 ORDER:
This writ petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking to issue a writ of mandamus declaring the action of the respondents in trying to acquire the extent of Acs.4.70 cts., of Agricultural land situated in Sy. No.31 of Kukunur Village in the Tallapudi Mandal through Section 4(1) notification dated 2-5-2007 and consequential actions under the Indiramma Padakam, as illegal, arbitrary and violative of the norms of acquisition and especially ignoring the earlier acquisition proceedings in respect of S. Nos.33/ 7C and 33/ 6 of extent of Ac.4.78 cts., and the proceedings of the 3rd respondent with a consequential direction to the respondents to consider a better suitable land for house sites purposes than the petitioner's land.
2. When the matter is taken up for hearing, it is submitted by the learned Government Pleader for Land Acquisition that the cause of action in the writ petition does not survive as the land acquisition proceedings initiated earlier, which is the subject matter of the writ petition, have been withdrawn by the Department and that they are not pressing for the same.
3. Recording the said submission of the learned Government Pleader, the writ petition is disposed of. Miscellaneous petitions, if any, pending shall stand dismissed. No order as to costs. ___________________ T. AMARNATH GOUD, J February 08, 2018 KTL
