THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.7261 of 2016 ORDER:

The case of petitioner is that the petitioner's father worked as Assistant Manager in the office of Food Corporation of India, Guntur and he died on 28.10.2003 due to chronic renal failure and survived by wife and two sons. The petitioner is the elder son in the family. The Tahsildar, Guntur, issued a Family Members Certificate on 30.04.2013. The petitioner sought appointment on compassionate grounds in the month of August 2004 and the application was rejected on the ground that the case was delayed by more than three years. Later on, basing on the judgment of the High Court of Allahabad, pending cases were reviewed and the respondent No.2 informed the petitioner to submit an application for compassionate appointment.

Accordingly, the petitioner submitted an application in the month of May 2013 to respondent No.2. The petitioner was asked to attend the office for verification of documents on 19.02.2014 and on the said date, the petitioner attended the office and the respondents verified the documents. When no further orders were received pursuant to the said verification, the present writ petition was filed. Though this case was adjourned from time-to-time and lastly four weeks time was granted on 06.06.2016, no counter affidavit is filed by the respondents.

In view of the nature of relief sought for in this writ petition, this Court is inclined to dispose of this writ petition by directing the respondent No.2 to pass appropriate orders relating to the case of petitioner for appointment on compassionate grounds, pursuant to

verification of the documents on 19.02.2014, within a period of three (3) months from the date of receipt of a copy of this order. Accordingly, this Writ Petition is disposed of. No order as to costs. Miscellaneous petitions pending, if any shall stand closed.
