HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.23577 of 2003 ORDER:

This writ petition is filed seeking to issue a Writ of Mandamus declaring the action of the respondents in rejecting the claim of the petitioner for appointment as Conductor/Shramik or any other suitable post under Bread Winner Scheme vide his proceedings dated 13.9.2002, as illegal and arbitrary; to set aside the same, and consequently, to direct the respondents to appoint the petitioner under Bread Winner Scheme as conductor/Shramik.

Heard Sri S.A.K. Mynoddin, learned Counsel for the petitioner and Sri A. Rama Rao, learned Standing Counsel for the respondents.

It has been contended by the petitioner that his father used to work as leading hand with the respondents and he died while he was discharging his duties on 5.5.2002, and thereafter, the petitioner submitted a representation dated 20.6.2002 to consider his case for employment under Bread Winner Scheme, but the respondents rejected his case vide order dated 13.9.2002 on the ground that there is a ban on recruitment. Aggrieved by the same, the present writ petition is filed.

The learned Counsel for the petitioner contended that appropriate orders may be passed in this writ petition directing the respondents to consider the case of the petitioner for appointment under Bread Winner Scheme.

The learned Standing Counsel for the respondents contended that if the petitioner submits a representation, appropriate orders will be passed in accordance with rules. 6.

Having considered the above submission, the petitioner is directed to submit a representation to the respondents within a period of two (2) weeks from the date of receipt of a copy of this order. On such representation being made, the respondents shall consider the same and pass appropriate orders, within a period of four (4) weeks thereafter, in accordance with the rules and regulations.

With the above direction, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
