THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 11534 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.1 in Crime.No.183 of 2023 on the file of Marikal Police Station, Narayanpet District, registered for the offences under Sections 307, 324, 332, 341, 353, 342, 143, 148 and 506 r/w. 34 and 149 of IPC and Section 4 of PDPP Act. 2.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The facts of the case are that several villagers were conducting hunger strike without permission of the Government since 114 days. Several cases were registered against the participants for their illegal acts. On 21.10.2023, a mob of nearly 200 people stopped the truck of Jurala Organic Farm and Agro Industries, which was established in the area. The said truck was carrying 40,000 litres of

inflammable substances. The protestors were opposing the establishment of the company which was producing ethanol. 4.

Learned Additional Public Prosecutor on instructions would submit that the Inspector who had gone there on duty was injured, as such, the case was registered under Section 307 of IPC.

Admittedly, the case is one of that, 200 protestors were agitating against the establishment of the company. Since no specific allegation is made against this petitioner and he only shared part of the alleged mob, the prayer for regular bail can be considered, subject to following conditions:- i) The petitioner/Accused No.1 shall execute personal bond for a sum of Rs.10,000/- (Rupees Ten thousand only) with two sureties, for a like sum each to the satisfaction of the Judicial Magistrate of First Class, Narayanpet.

ii) The petitioner/Accused No.1 after release shall appear before the concerned Station House Officer at 10:00 a.m. everyday for a period of two weeks for the purpose of investigation and thereafter, as and when required.

(iii) The petitioner/Accused No.1 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C.

Accordingly, the Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
