HON'BLE SRI JUSTICE SURESH KUMAR KAIT & HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P. No. 28270 of 2018 O R D E R:- (ORAL) (Per Hon'ble Sri Justice Suresh Kumar Kait) This writ petition is filed challenging the order dated 13.07.2018 in O.A.No. 1357 of 2018 passed by the A.P. Administrative Tribunal, Hyderabad, whereby the application filed by the petitioner under Section 19 of the Administrative Tribunals Act, 1985, has been dismissed on the ground that the orders issued by the Government in G.O.Ms.No. 257, dated 10.06.1999 are not applicable to the case of the petitioner. Heard the learned counsel for both the parties and perused the material placed on record.
The learned counsel for the petitioner has submitted that G.O.Ms.No. 257, dated 10.06.1999 is applicable to the case of the petitioner which is not disputed by the learned Government Pleader for Excise Department (A.P.) appearing on behalf of the respondents.
In view of the above, the order dated 13.07.2018 in O.A.No. 1357 of 2018 passed by the Tribunal is hereby set aside, and consequently, the respondents are directed to consider the case of the petitioner for promotion strictly in terms of the orders issued by the Government in G.O.Ms.No. 257, dated 10.06.1999.
SKK,J & AKS,J WP_28270_2018 Accordingly, the writ petition is disposed of. No order as to costs.
As a sequel, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
