HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.40961 of 2016 ORDER:

This writ petition is filed by the petitioner under Article 226 of the Constitution of India challenging the inaction of the respondents in not granting permission to conduct public meeting on 25.11.2016 from 6 p.m., to 10 p.m., at Marxist Vignana Kendram Koduru, Krishna District. 2.
Heard and perused the material available on record. 3.
It is the case of the petitioner that he is the District President of APRCS organization and on 17.11.2016 he made an application to the 3rd respondent seeking permission to him to conduct a public meeting on 25.11.2016 and on the said application, the 2nd respondent endorsed that since there are two groups in Koduru Mandal, there is every chance of law and order problem. In view of the said endorsement, the 3rd respondent has not passed any orders.

Considering the facts and circumstances of the case and the grievance of the petitioner, without expressing any opinion on merits, the Writ Petition is disposed of with the following directions: "The respondents are directed to allow the petitioner to conduct a public meeting on 25.11.2016 at Marxist Vignana Kendram, Koduru Mandal, Krishna District, by imposing necessary conditions for conducting the meeting in a peaceful manner. If the petitioner and the members of the organization violate the conditions so imposed, the respondents are at liberty to take appropriation action, in accordance with law."
No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed. The petitioner is at liberty to communicate the order of this Court by way of filing affidavit before the respondents-concerned. ________________ RAJA ELANGO, J Date: 25th November, 2016 Nn
