THE HON'BLE SRI JUSTICE R.KANTHA RAO Civil Revision Petition No.3231 of 2015 ORDER:

This revision petition is directed against the order dated 17.07.2015 in I.A.No.1389 of 2015 in A.T.A.No.11 of 2015 on the file of the Principal District Judge, Rajahmundry at East Godavari preferred against the decree and order passed in A.T.C.No.12 of 2007 dated 30.04.2015 on the file of the Special Officer-cum-Principal Junior Civil Judge, Amalapuram, East Godavari District. 2.

The tenancy appeal was filed against the order, dated 30.04.2015 passed by the Special Officer-cum-Principal Junior Civil Judge, at Amalapuram in A.T.C.No.12 of 2007 whereunder the learned Court directed the tenant/revision petitioner to pay fair rent @ 20 bags of paddy per acre per year from the date of petition in respect of the petition schedule land and also directed to pay cost of 800 coconuts at the rate of Rs.3/- per coconut from the date of petition. Against the said order, the tenant filed the aforementioned I.A.No.1389 of 2015 before the appellate Court to grant stay of the order passed by the Special Officer-cum-Junior Civil Judge, at Amalapuram. The learned District Judge directed the respondents to deposit the value of 10 kata bags of paddy if became due and to deposit the value of 5 kata bags of paddy per acre per year from the date of filing of the petition within one month from the date of passing of the order and also directed the parties to advance the arguments in the appeal within two months.

3. Heard the learned counsel appearing for the petitioner.

4. Having regard to the facts and circumstances of the case, I do not see any error of jurisdiction committed by the learned District Judge in passing the impugned order pending disposal of the appeal. The order therefore does not require any interference in the present revision petition. 5.

The civil revision petition is, therefore dismissed at the stage of admission. There shall be no order as to costs. Miscellaneous petitions, if any, filed in this revision shall stand closed.
