HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.38413 of 2016 ORDER:
This writ petition is filed seeking to declare the action of the 3rd respondent in interfering with the civil disputes between the petitioner and respondents 5 and 6 and calling the petitioner to the police station, as illegal and arbitrary, and consequently, direct the 3rd respondent not to interfere with the civil disputes. Heard and perused the material available on record. The grievance of the petitioner is that he is owner of an extent of Ac.0.10 cents of land and he constructed an apartment with Stilt + Ground + 3 floors. The respondents 5 and 6 have instigated the 3rd respondent to pressurize the petitioner to register the flats in their names on the allegation that the petitioner had obtained loan from them.
At the instigation of the respondents 5 and 6, the 3rd respondent is calling the petitioner to the police station and pressurized him to settle the issue by registering the flats in the name of the respondents 5 and 6 or otherwise, he would be implicated in criminal cases. Learned Assistant Government Pleader for Home submitted that the respondent police are not intending to interfere with the civil disputes.
Considering the circumstances of the case, without expressing any opinion on merits, the Writ Petition is disposed of with the following direction:
" The 3rd respondent is directed not to interfere with the affairs of the petitioner and the respondents 5 and 6, more particularly, with the civil disputes pending between
them. However, this order will not stand in the way of the 3rd respondent to register a case, if any complaint is lodged against the petitioner for cognizable offence." There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. ______________ RAJA ELANGO, J November 08, 2016.
