THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION NO.11963 OF 2015 O R D E R :

This writ petition is filed for a Writ of Mandamus declaring the action of the respondents in asking the petitioners to produce the "No Objection Certificate" from the District Collector, Hyderabad for grant of building permission for construction in H.No.10-3-313/C, comprising ground and first floor consisting 700 sft and 800 sft of built up areas each floors admeasuring land area of 438 sq,yards or 366.16 sq.mts situated at Potti Sriramulu Nagar, Masab Tank, Hyderabad as illegal and arbitrary and for a consequential direction to consider the petitioners' request for building permission without insisting upon "No Objection Certificate"

Today, when the matter is taken up for hearing, it is submitted by the learned counsel for the petitioners that the subject matter of the writ petition is squarely covered by the order dated 10.11.2014, passed by this Court in W.P.No.33572 of 2015 and the same is not disputed by Sri P. Krishna Reddy, the learned Standing counsel for the respondents 2 to 4. For the reasons alike in the above mentioned order, this writ petition is disposed of directing the 2nd respondent-GHMC to take appropriate decision on the application made by the petitioners seeking permission to construct a building in accordance with the provisions of the Hyderabad Municipal Corporation Act, 1955 and the Building Rules and Regulations made there under, without insisting for production of "No Objection Certificate". No costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
