HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 7190 OF 2003 ORDER :
This Writ Petition is filed seeking to issue a Writ of Mandamus or any other appropriate, writ declaring the action of the respondents in not extending the Earned Leave Encashment benefit to the petitioners herein as illegal, arbitrary and sought a consequential direction to the respondents to make payment to the petitioners, towards the Encashment of Earned Leave. 2.
It has been contended by the Counsel for the petitioners that the petitioners were employed with the 4th respondent and that they have attained the age of superannuation. The grievance of the petitioners is that the 4th respondent is not extending the benefit of Earned Leave Encashment, in spite of the fact that they are entitled for the same benefit. 3.
Mr.N.Siva Reddy, Counsel for the 4th respondent had contended that the petitioners are not entitled for Encashment of Earned Leave and there are no merits in the Writ Petition and the Writ Petition is liable to be dismissed. 4.
Having considered the submissions made by the parties, this Court is of the considered view that this Writ Petition can be disposed of, directing the petitioners to make a fresh representation within two weeks and upon such representation being received, the respondents shall consider and pass appropriate orders within a period of four weeks thereafter. 5.
With this observation, the Writ Petition is disposed of. 6.
