THE HON'BLE SRI JUSTICE A. RAJASHEKER REDDY CIVIL REVISION PETITION No.1339 OF 2016 ORDER:

This revision petition is filed questioning the maintainability of E.P.No.29 of 2015 in O.S.No.139 of 2013 on the file of I Additional District Judge, Kurnool, by stating that without transferring the decree passed in the aforesaid Suit, the present E.P. is filed and that the E.P. filed before the trial Court is still pending. A perusal of the record discloses that no order is passed in the present E.P. Therefore, the petitioner can raise all his objections in E.P.No.29 of 2015 and the Court below shall take the same into account while passing any order in the said E.P., and if the petitioner is still aggrieved, it is open for him to challenge such order.

With the above observations, the revision petition is dismissed. Miscellaneous Petitions, if any, pending in this revision petition, shall stand closed. No costs. __________________________ A. RAJASHEKER REDDY, J March 15, 2016 MD
