folder subject to corrections if any This application is filed by the petitioner-accused No.1 to relax the condition No.(ii) imposed against the petitioner while granting bail by this Court in Crl.P. No.11540 of 2023 dated 04.12.2023.

Heard learned counsel for the petitioner and the learned Additional Public Prosecutor.

The learned counsel for the petitioner submitted that the petitioner was granted bail on 04.12.2023 in the above criminal petition and while granting bail, this Court directed the petitioner to appear before the concerned police on every Monday at 10.00 AM until further orders as per condition No.(ii). The petitioner was complying with the said condition and was attending before the concerned police regularly for more than three (3) months of his release. Now, the petitioner was suffering with health issues and the doctor advised him to undergo surgery and to take complete bed rest, and prayed to relax the condition No.(ii) in the order dated 04.12.2023.

Learned Additional Public Prosecutor reported that the bail was granted to the petitioner after filing charge sheet in SC No.322 of 2017 on the file of Principal District and Sessions Judge, Nagarkurnool. He reported that the petitioner was appearing before the concerned SHO regularly till date. Considering the submissions of both the learned counsel and as no fixed time period was stipulated by this Court for the

appearance of the petitioner before the concerned police and the petitioner is complying with the said condition for the more than three (3) months and also considering the health condition of the petitioner stated by the learned counsel for the petitioner, it is considered fit to relax the above condition.

Accordingly, the application is allowed relaxing the condition No.(ii) in the order dated 04.12.2023 in Crl.P. No.11540 of 2023, imposed by this Court against the petitioner while granting bail.
