HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No. 15272 of 2016 PC: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) This Habeas Corpus petition is filed by one Shiva Shankar Kumar Suman seeking production of his wife - Smt. Sweta, and their minor son - Master Ch.Samrat, contending that they were taken by the police more than 21⁄2 years ago.

On the other hand, learned Government Pleader for the respondents submits that the wife of the petitioner left his company more than 21⁄2 years ago and presently she is residing with her parents at Jamshadpur. He further submits that the allegations made by the petitioner in the writ petition are absolutely false and baseless. He also produced letters, both dated 13.06.2016, signed by father-in-law and his wife in the presence of notary stating that his wife is living with her parents in view of the threats she is receiving from the petitioner. The letters and the photograph of the petitioner's wife, child and fatherin-law are taken on record and marked 'X' for identification. In this view of the matter, writ petition is dismissed. Dismissal of the writ petition, however, shall not preclude the petitioner from approaching the family Court for appropriate relief.
