HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.900 OF 2009 ORDER:

This petition is filed for a writ of Mandamus declaring the action of the 3rd respondent in issuing eviction notices dated 17.01.2009 and in issuing public auction notice dated 17.01.2009, directing the petitioners to vacate the shop bearing Nos.20-3209/A and 20-3-209/B and scheduling the public auction for the above shops on 24.01.2009, as arbitrary and illegal and contrary to circular No.12/2005 dated 25.10.2008 and for a consequential direction to the respondents to extend the lease on enhancement of rents.

This Court while admitting the writ petition on 23.01.2009, granted interim direction stating that the auction as scheduled on 24.01.2009 may go on, but the same shall not be finalized until further orders.

Now, Sri Ch.Satish Kumar, learned counsel for the 3rd respondent-temple states that in pursuance to the interim direction, petitioner also participated and declared as successful bidder in the auction process and leasehold rights were also granted to them and as such, the cause in the writ petition does not survive for adjudication.

Recording the aforesaid submission of the learned counsel for the 3rd respondent, the writ petition is dismissed as infructuous. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any pending

in the writ petition, shall stand closed.
