THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.9443 OF 2022 O R D E R:

This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C.") seeking pre-arrest bail to the petitioner/Accused No.1 in the event of the arrest in connection with Crime No.191 of 2022 on the file of Station House Officer, Dubbak Police Station, Siddipet District registered for the offences punishable under Sections 341, 324, 506, 290 r/w 34 of Indian Penal Code and Section 3(1)(r)(s) of the Schedule Caste and Schedule Tribes (Prevention of Attrocities) Act, 1989.

Heard the learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State.

Perused the record.

The case was registered against the petitioner and his father on the allegation of beating the de facto complainant in a public place causing nuisance having knowledge that the de facto complainant belonged to scheduled caste.

Learned Public Prosecutor submits that the investigation is completed and charge sheet is filed. For the reason of charge sheet being filed, the father of the Accused was granted regular bail.

Learned counsel for the petitioner further submits that the petitioner was advised bed rest as his left leg was fractured.

For the reason that his left leg is being fractured and as the investigation is already concluded, the petitioner can be granted the relief of anticipatory bail.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused No.1 is granted anticipatory bail subject to the following conditions:

i) The petitioner/Accused No.1 is directed to surrender before the Station House Officer, Dubbak Police Station, Siddipet District within two weeks from today, and on such surrender, he shall be enlarged on bail on executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) with two sureties each to the like sum each, to its

satisfaction.

ii) The petitioner/Accused No.1 shall appear before the concerned Station House Officer on every day between 10.30 AM and 01.00 PM before the concerned Court.

iii) The petitioner/Accused No.1 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C. Miscellaneous applications, if any pending, shall stand closed.
