THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.11563 OF 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioner/Accused seeking bail in the event of her arrest in connection with Crime No.147 of 2023, on the file of Borabanda Police Station, Hyderabad, registered for the offence under Section 306 of IPC.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondentState and perused the record. 3.

The case of the prosecution is that the deceased is the daughter-in-law of this petitioner. She committed suicide. The case is that she was having hearing problem and this petitioner and her husband were commenting on her hearing problem, because of which, the deceased went into depression and committed suicide by hanging.

This Court by order dated 29.09.2023 granted regular bail to A-1. Keeping in view that this petitioner is a woman and no specific overt acts are attributed to this petitioner except stating that she has commented the deceased, the relief of anticipatory bail can be granted, subject to following conditions:-

1) The petitioner/Accused is directed to surrender before the Station House Officer, Borabanda Police Station, Hyderabad, on or before 04.12.2023. Upon such surrender, the said Station House Officer shall release the petitioner/Accused on bail, on his executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to his satisfaction.

2) On such release, the petitioner/Accused shall appear before the concerned Police at 10:00 a.m. for the purpose of investigation as and when required.

3) The petitioner/Accused shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
