THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 11553 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by petitioner/A2 seeking bail in the event of his arrest in connection with Crime No.137 of 2023, on the file of Dharoor Police Sttion, JogulambaGadwal District. The offences alleged against the petitioner are under Sections 506, 509, 305 of the Indian Penal Code and Section 11 r/w.12 of the POCSO Act, 2012.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record. 3.

According to the complaint, it is alleged that the girl was harassed by Accused No.1. Ultimately, on account of such harassment, she committed suicide. However, in the complaint, when Accused No.1 was confronted, he stated that he has support of this petitioner. In the entire complaint, there is no allegation of any involvement of this petitioner in the alleged crime.

In the said circumstances, the relief of Anticipatory Bail can be granted to the petitioner subject to the following conditions:

1) The petitioner/A2 is directed to surrender before the Station House Officer, Dharoor Police Station, Jogulamba-Gadwal District, on or before 04.12.2023. On such surrender, the said Station House Officer shall release the petitioner/A2 on

bail, on his executing personal bonds for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to his satisfaction.

2) On such release, the petitioner/A2 shall appear before the concerned police on every Monday between 10.00 a.m. to 1.00 p.m. for a period of four weeks, thereafter as and when required, for the purpose of investigation.

3) The petitioner/A2 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
