It is stated by the learned counsel for the petitioner that the lis in this Writ Petition is squarely covered by order of this Court dated 30.08.2018 in WP No.26625 of 2018.
Heard learned counsel for the petitioner and learned Government Pleader for General Administration Department (Telangana).
In WP No.26625 of 2018, the impugned order was passed changing the petitioner's i.e., from A category to 'B' category, without issuing any notice to the petitioner therein. In this case also, petitioner was not issued any notice before issuing the impugned proceedings dated 20.07.2018.
Learned Government Pleader for General Administration Department submits that an e-mail was sent to the petitioner on 04.07.2018 and same is disputed by the learned counsel for the petitioner.
Since the impugned order dated 20.07.2018 in letter No.0042556/Advt.II/2017-18-6 entailing civil consequences is passed, the respondents should have issued notice to the petitioner. Moreover, no Rule is brought before this Court to show that a notice can be sent through e-mail for service of notice. In view of above facts and circumstances, for the reasons alike in WP No.26625 of 2018, dated 30.08.2018, the impugned letter No.0042556/Advt.II/2017-18-6, dated 20.07.2018 is set
aside and the Commissioner of Information and Public Relations is directed to issue fresh notice to the petitioner and after affording an opportunity of hearing to him, pass appropriate orders in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.
