THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.9422 OF 2022 ORDER:

This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 seeking bail to the petitioner in the event of arrest in Crime No.22 of 2022 on the file of Station House Officer, Wyra, Khammam District registered for the offence punishable under Section.306 of Indian Penal Code.

Heard learned counsel for petitioner and learned Additional Public Prosecutor for respondent-State. Perused the record.

The case against the petitioner is that he is involved in the offence of abetment of suicide on the ground that, Accused No.1, has given loan to the deceased, who harassed the deceased to repay the said amount. When the deceased failed to repay the money, A1 informed petitioner and the petitioner sent messages asking the deceased to pay the money to Accused No.1.

Even according to the remand report of the Accused No.1, this petitioner has sent messages asking the deceased to repay the amount of loan. Prima facie, demand to repay the amount given as loan, does not amount to offence of abetment of suicide, for which reason, the petitioner can be granted relief of anticipatory bail subject to the following conditions:- i) The petitioner is directed to surrender before the Station House Officer, Wyra, Khammam District within ten

(10) days from today, and on such surrender, he shall be enlarged on bail on executing personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties for a like sum each (among which one local and one native surety), to its satisfaction.

ii) On such release, the petitioner shall appear before the investigating authority as and when required for the purpose of investigation.

iii) The petitioner shall abide by the other conditions stipulated in Section 438(2) Cr.P.C.

Accordingly, the Criminal Petition is allowed.

Miscellaneous applications, if any, pending shall stand closed.
