THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.26027 OF 2008 ORDER:

This petition is filed for a writ of Mandamus declaring the action of the respondents 1 to 4 in not taking action against the 5th respondent, as illegal and arbitrary and for a consequential direction to the respondents 1 to 3 to forthwith initiate action against the 5th respondent.

The 2nd respondent filed counter affidavit stating that enquiry was conducted and as per the report of the Divisional Panchayat Officer, Karimnagar, certain financial and procedural irregularities have been noticed; that basing on the said report, the cheque drawing powers of the Sarpanch have been withdrawn as primary measure and show cause notice dated 27.11.2008 also issued to the 5th respondent calling explanation. Thereafter, since in the earlier enquiry report, the allegations of the Sarpanch are not covered in detail, the Divisional Panchayat Officer again conducted enquiry and submitted a report dated 19.12.2008, and basing on the said report the respondents concluded enquiry stating that there are no serious financial lapses or loss caused to the Gram Panchayat which require major punishment found on the part of the Sarpanch, Gram Panchayat, Vavilala for the improper supervision; and the cheque drawing powers of the Sarpanch Gram Panchayat, Vavilala has already been stopped and the said aspect is also informed to the petitioner on 01.06.2009.

Heard both sides.

Since it is stated in the counter that action has already been initiated against the 5th respondent on the representation of the petitioner, the grievance of the petitioner stands redressed, as such no further orders are required to be

pass in the writ petition.

Accordingly the writ petition is closed. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
