HON'BLE SRI JUSTICE R.KANTHA RAO C.M.S.A.No.40 of 2011 Judgment:

Despite this Court passing conditional order dated 03-9-2015, the appellant did not pay process fee or batta to serve notice on the 3rd respondent. Therefore, the appeal against the 3rd respondent was dismissed for default by this Court through order dated 29-92015. No steps to implead the legal heirs of deceased 4th respondent as sought for by the learned counsel appearing for the appellant have been taken so far.

Sri Raja Reddy Koneti, learned counsel appearing for the appellant, reports no instructions from the appellant. Hence, the appeal is dismissed for default/ non-prosecution. The miscellaneous petitions, if any, pending in this appeal shall stand closed. No costs.
