Learned counsel for the petitioner submits that the respondent Police are not following the guidelines laid down by the Apex Court in Arnesh Kumar v. State of Bihar and another1 by issuing 41- A Cr.P.C. and requested this Court to issue a direction to the respondents to follow the guidelines framed by the Apex Court in Arnesh's case referred supra by issuing 41-A Cr.P.C.
Learned Assistant Government Pleader for Home, on written instructions, submits that the petitioner/ accused is absconding and the wife of the petitioner threatened the police and as such a case in Cr.No.198 of 2018 was registered against his wife for the offence under Section 353 IPC.
In view of the same, the petitioner is directed to appear the respondent police within a period of one week from the date of receipt of a copy of this Order and on such appearance, the respondent Police are directed to follow the procedure laid down by the Apex Court in Arnesh's case referred supra.
With the above direction, this Writ Petition is disposed of. The miscellaneous petition, if any, in this Writ Petition, shall stand closed.
