THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.13283 of 2024 ORDER:
Seeking the Court to enlarge the petitioner who is arrayed as accused in Crime No.1355 of 2024 of Narsingi Police Station, Cyberabad, on bail, the present Criminal Petition is filed.

The brief facts of the case are that the victim has got acquaintance with the accused while she was pursuing her acting course at Mayank Talkies in Yousufguda, Hyderabad. Thereafter, the accused used to visit the house of the victim very often to write short film stories. It is stated that the accused misbehaved with the victim when she is alone at her house and pressurized the victim to enter into relationship with him. Later, when the victim came that the accused is having relationship with another woman, the victim experienced a panic attack. Hence, a case was registered vide Crime No. 1355 of 2024 before Narsingi Police, Cyberabad, for
the offences punishable under Sections 376(2)(n) of IPC and Section 5 (1) r/w 6 of POCSO Act, 2012.

Heard Sri Kore Vishwanath, learned counsel appearing on behalf of the petitioner as well as Sri Syed Yasar Manoon, learned Additional Public Prosecutor appearing on behalf of respondent-State.

Learned counsel for the petitioner submitted that the petitioner is innocent and has been falsely implicated in the case. He further submitted that petitioner has no past criminal antecedents. Hence, he prayed the Court to grant bail to the petitioner by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the bail application of the petitioner stating that the investigation is not yet completed and there are serious allegations against the petitioner, if the petitioner is released on bail, there is every chance of threatening the victim and tampering the evidence.
Therefore, he prayed the Court to dismiss the criminal petition.

After considering the submissions made by both the parties and reviewing the record, it apparent that the petitioner is in jail from 13.09.2024 and the petitioner submitted that victim reported no objection for bail in the trial Court. That apart, material part of investigation is completed, hence, this Court deems it fit to grant bail to the petitioner with the following conditions: i.
The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the learned Special Sessions Judge for Trial and Disposal of Cases under POCSO Act, Ranga Reddy District at L.B.Nagar.
ii.
The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) weeks, for the purpose of
investigation, and thereafter, as and when required.
iii.
The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.(presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
