Heard learned counsel for the petitioner and learned Public Prosecutor, representing the State, and perused the material on record. 2.

There is no force in the contention that the accused need not appear for re-call of non-bailable warrant issued in the private complaint case of a summons or summary trial, even for what the expression referred is the Court need not insist, does not mean he can decide not to attend. However, the fact remains that he can appear and execute bond for his release as contemplated by Section 88/89 Cr.P.C. with or without sureties as ordered by the learned Magistrate, by virtue of this order.
