THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRL.R.C.M.P.No. 3669 OF 2017 AND/IN CRL.R.C.NO.1120 OF 2012 ORDER:

Crl.R.C.M.P.No.3669 of 2017 is filed under Section 147 of the Negotiable Instruments Act with a request to record compromise.

Both parties present and identified by their respective counsel in the open Court and produced Photostat copies of Adhar cards in proof of their identity.

When this Court explained the terms of compromise, both the parties admitted that the contents of the compromise are true and they also complied with the direction issued by the Apex Court to deposit 15% of the cheque amount to the credit of High Court Legal Services Committee, as ordered by this Court, by following guideline No.3 of the judgment of Apex Court in Damodar S Prabhu Vs. Sayed Baba Lal H1.

Hence, I find that the compromise is voluntary and permission is granted to compound the offence, in view of payment of requisite amount.

Accordingly, Crl.R.C.M.P.No.3669 of 2017 is ordered and the compromise is recorded acquitting the petitioner/accused for the offence punishable under Section 138 of Negotiable Instruments Act. The bail bonds, if any, executed by the petitioner/accused shall stand cancelled.

1 AIR 2010 SC 1907

In the result, criminal revision case is disposed of accordingly.

Consequently, miscellaneous applications pending if any, shall stand dismissed.
