2015-03-20Challa Kodanda Ram2 pages

THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION NO.7218 of 2015 Between:

1. Chiluka Nagaraju and naother PETITIONERS AND

1. State of Telangana, rep. by its Principal Secretary, Revenue Department, A.P., Secretariat Buildings, Hyderabad, and others. RESPONDENTS

ORDER:

The case of the petitioners is that the 1st petitioner owns Ac.5.31 gts., and the 2nd petitioner owns Ac.7.40 gts of land in different survey numbers. They dug a bore well in the said lands by obtaining necessary permission for cultivating their land. They allege that respondents 4 to 7 dug bore well and using water for commercial purpose without obtaining any prior permission from the competent authority under Andhra Pradesh Water, Land and Trees Act, 2002 (for short 'the Act'). Their grievance is that though they have made an application before the District Collector and Tahsildar, no action has been taken so far. Hence they filed the present writ petition. Heard learned counsel for the petitioners and learned Assistant Government Pleader for Revenue (A.P.) for respondents.

Considering the limited grievance of the petitioners and that the petitioners have already submitted application to the District Collector and Tahsildar, interest of justice would be met if a direction is issued to the respondents to consider the application of the petitioners and pass appropriate orders in accordance with law.

Accordingly, the writ petition is disposed of directing the respondents to consider the application submitted by the petitioners and pass appropriate orders on the same in accordance with law. No costs. As a sequel, miscellaneous petitions, if any, shall stand closed. _____________________ CHALLA KODANDA RAM, J.
