HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.18140 OF 2016 ORDER:
The case of the petitioner is that his grand father is the owner and possessor of the land admeasuring Ac.1.50 cents in RS.No.188/1 of Nandamuru Village, Pedana Mandal, Krishna District; that the Government acquired the land admeasuring Ac.1.06 cents for the public purpose i.e. for providing house sites to the poor and eligible people; and that after acquisition of land by the Government, petitioner's grand father remained in possession of the land to an extent of 0.44 cents and after his life time the said land is devolved upon the petitioner. While so, in the year 1998 the respondent authorities have constructed a RCC building for the purpose of Anganvadi in the land belonging to the petitioner. As such, the petitioner made representations to the government authorities and the Government authorities came with a proposal stating that they will provide alternative land to the petitioner. But as no action has been taken the petitioner submitted representation dated 31.03.2015. But, so far the respondents did not take any action. Hence, the petitioner filed present writ petition.
Heard both sides.
Since the representation filed by the petitioner dated 31.03.2015 seeking alternative land, is pending before the 2nd respondent, the respondent authorities are directed to consider the representation of the petitioner and take appropriate action within a period of three months from the date of receipt of a copy of this
order.
Accordingly, the writ petition is disposed of. No order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
