THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.8376 of 2018 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C., to quash the proceedings in Crime No.599 of 2018 of Gachibowli Police Station, Cyberabad District, registered for the offences punishable under Sections 447 and 427 IPC against the petitioner/accused. 2.

After arguing the matter for a while, learned counsel for the petitioner-accused requested the Court to issue a direction to the police concerned to follow the procedure under Section 41-A Cr.P.C and the guidelines issued by the Apex Court in judgment reported in Arnesh Kumar v. State of Bihar and another1, while investigating the above crime.

Acceding to the request of learned counsel for the petitioner, the Criminal Petition is disposed of directing the Station House Officer, Gachibowli Police Station, Cyberabad District, to follow the procedure under Section 41-A Cr.P.C and the guidelines issued by the Apex Court in the above referred Judgment, before taking any coercive steps against the petitioner.

Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
