HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.35767 OF 2016 ORDER:
This Writ Petition under Article 226 of the Constitution of India is preferred by the petitioner seeking to declare the inaction of respondents 1 and 2 in taking action on petitioner's representation dated 22.08.2016 as arbitrary and illegal. Heard the learned counsel for the petitioner and the learned Asst. Government Pleader for Revenue (AP). With their consent, the Writ Petition is disposed of at the stage of admission itself. There is no necessity to put respondent No.3 on notice as this Court is not venturing to adjudicate the issue on merits. The limited grievance of the petitioner in this writ petition is that his representation dated 22.08.2016 complaining about R.3 is not being taken up and disposed of by R.2.
Learned AGP submits that since the representation was made in the month of August, 2016, necessary direction may be issued to R.2 to dispose of the representation, if not already disposed of.
Having regard to the rival submissions made, the Writ Petition is disposed of directing the 2nd respondent to consider the representation of the petitioner dated 22.08.2016 and dispose of the same after hearing the petitioner and aggrieved persons, if any, including the 3rd respondent herein, in accordance with law as
early as possible preferably within a period of two months from the date of receipt of a copy of this order.
