THE HON'BLE SRI JUSTICE S. RAVI KUMAR WRIT PETITION No.14474 of 2003 ORDER:
This writ petition is filed to declare proceedings No.P3/255(1)/2001-RM,
Mahabubnagar, dated 04-03-2003 in re-categorising the petitioners from the post of Coach Building to the Painter-cum-Trimmer as illegal and arbitrary.
2. This Court granted interim direction and thereafter the Corporation filed a petition to vacate the interim order and considering the contentions and rival contentions of both parties, this Court passed the following order on 05-012004:- "This application seeks vacation of the interim order in WPMP No.17916/03, Dt.5.11.03, which reads as under:- "There shall be an interim direction to the respondents to continue the petitioners as Artisan Grade-1 without reduction of his pay and emoluments.
However, this will not preclude the authorities from utilising the services of the petitioner in any category. Notice." By the order of R2 Dt.4.3.2003 the writ petitioners were re-categorised as Painters and Painters-Trimmers. Learned Standing Counsel for respondentCorporation states that the writ petitioners suffer no diminution in pay or emoluments as a consequence of such re-categorisation. The order of this Court has also preserved liberty in the Corporation to utilise the services of the petitioners in any category.
In the circumstances, the interim order causes no manner of prejudice to the Corporation. The WVMP is seen to be misconceived and is therefore dismissed."
3. Heard arguments of both sides.
4. It is represented that the writ petition can be disposed of in terms of the interim order dated 05-01-2004.
5. Considering the submissions of both sides, the writ petition is disposed of in terms of the interim order dated 05-01-2004. No costs.
6. As a sequel, miscellaneous petitions, if any, pending in this writ petition,
shall stand disposed of.
