HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 10203 of 2004 ORDER:
This writ petition is filed seeking to issue a writ of mandamus declaring the action of the respondent in not regularizing the services of the petitioners as Divisional Managers, as illegal and arbitrary. A consequential direction is also sought to the respondent to regularize the services of the petitioners from the date on which they were promoted as Divisional Manager in Class-I Senior scale cadre with all consequential benefits.
While admitting the writ petition, this Court directed the respondent to continue the petitioners as Divisional Managers, vide orders dated 22.06.2004 in WPMP No.12958 of 2004. When the matter is taken up for hearing, learned counsel for the petitioners submits that by virtue of the interim orders, the petitioners were allowed to continue in the promoted post and they have retired from service on attaining the age of superannuation and in view of the same, no further orders are necessary in the writ petition. Accordingly, the writ petition is closed. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed. No order as to costs.
