HON'BLE SRI JUSTICE K. LAKSHMAN WRIT PETITION No.39571 of 2022 ORDER:
Heard Sri Rapolu Bhaskar, learned counsel appearing for the petitioner and learned Assistant Government Pleader for Revenue.
This writ petition is filed to declare the action of respondents 3 and 4 in not-considering the F-line application of the petitioner bearing No.TTDER021800276021 dated 17-06-2018 for conducting survey and sub-division in respect of lands admeasuring Ac.0-30 gts., in Sy.No.59/20, ac.1-07 gts., in Sy.No.61/15, Ac.1-13 gts., in Sy.No.62/22 total admeasuring Ac.3-10 gts., situated at Gujja revenue village shivar, Narayanpur mandal, Yadadri Bhuvanagiri District, as illegal and consequently direct respondents to consider the F-line application of petitioner.
The petitioner is claiming that he is the absolute owner and possessor of lands admeasuring Ac.0-30 gts., in
Sy.No.59/20, ac.1-07 gts., in Sy.No.61/15, Ac.1-13 gts., in Sy.No.62/22 total admeasuring Ac.3-10 gts., situated at Gujja revenue village shivar, Narayanpur mandal, Yadadri Bhuvanagiri District. In proof of the same, he has filed old pattedar pass books. He has made F-line application bearing No.TTDER021800276021 dated 17-06-2018 to respondent No.3 with a request to conduct survey and demarcate the aforesaid land. Despite receiving and acknowledging the said F-line application, respondent No.3 did not act upon the same, therefore, the present writ petition.
Whereas learned Assistant Government Pleader for Revenue, on instructions, would submit that respondent No.3 will consider the said F-line application submitted by the petitioner and pass appropriate orders, in accordance with law.
In view of the aforesaid discussion, this writ petition is disposed of, directing respondent No.3 to consider F-line application bearing No.TTDER021800276021 dated 17-06-2018 submitted by the petitioner to conduct survey
and demarcate the aforesaid lands of the petitioner and pass appropriate orders, strictly in accordance with law by putting the petitioner and all the affected parties on notice and affording them an opportunity of hearing. If respondent No.3 is not inclined to accept the claim / request of the petitioner, he shall mention specific reasons and pass reasoned order. In the F-line application dated 17-06-2018, respondent No.3 is at liberty to call for information / documents if required from the petitioner. He shall communicate the said order to the petitioner. He shall complete the entire exercise within a period of 45 (forty five) days from the date of receipt of a copy of this order. There shall be no order as to costs.
As a sequel, the miscellaneous petitions, if any, pending in the Writ Petition shall stand closed. __________________ K. LAKSHMAN, J October 27, 2022 PN
